9th Circumscription Upholds the dismissal of Glass Co’s cover lawsuit.

By Hope Patti (May 9, 2022, 1:27 p.m. EDT) — Liberty Mutual has no obligation to cover a California glassmaker’s $1.3 million settlement over glass panes the buyer says are defective, a Ninth Circuit panel asserted, saying the manufacturer failed to cite lawsuits that compelled the insurer to provide a defense and indemnity.

A federal court in California correctly dismissed Glasswerks LA’s lawsuit against Liberty Mutual, the appeals court said Friday, finding the insurer had not breached the insurance contract or acted in bad faith. Glasswerks also cannot support a claim for declaratory judgment because coverage is only triggered when the manufacturer is sued.
